The High Cost of No Prenup
Jana’s marriage to Mike Caussin lasted almost seven years, during which she believed they would be together forever. She didn’t ask Mike to sign a prenuptial agreement, which would have helped protect her finances in the case of divorce. She admits she never imagined they would split up and believed that their marriage would be her “one forever.”
However, as their marriage faced significant turmoil due to Mike’s infidelity, the reality of financial insecurity became apparent. Jana recalls how she made Mike sign a postnuptial agreement after he entered rehab for his infidelities. However, she later learned from her lawyer that postnuptial agreements do not hold the same weight as prenuptial agreements in court. Unfortunately, when their marriage finally ended in divorce, the postnuptial agreement did not protect her finances as she had hoped.
Reflecting on her divorce, Jana shared that she lost almost half of her money, money that she had worked hard to earn. This financial hit was particularly devastating, as she was the primary breadwinner in the relationship. “I realized how much I lost—almost half of my money—in my last divorce,” she said. Jana explains how difficult it was for her to bring up the subject of a prenuptial agreement in her new relationship. After all, no one wants to think about the possibility of their marriage ending in divorce, especially when they are in love and planning to spend the rest of their lives together. She acknowledged that discussing finances felt unromantic and awkward, especially with someone she loved deeply.
However, her team of lawyers and business managers reminded her that a prenuptial agreement is like “health insurance” for her life. Her lawyer emphasized that just as people get insurance to protect themselves from unforeseen health issues, a prenup is a form of protection in case a marriage doesn’t work out as planned. This advice helped Jana understand that having a prenuptial agreement isn’t about preparing for failure—it’s about being financially responsible, especially when children are involved.
